I could be wrong...  but I very much doubt it...  specially as these cars are used for rallying and It would be a safe bet that 99.9999% a motorbike how ever fast or what angle it went directly into a axle case even if the body of the car was removed would not in the slightest damage the differential gears  :-\

Fair enough, although I have seen it with a Maserati Ghibli which went into something sideways. Not so much the impact but the driving afterwards with the drive shaft pushing onto the output of the diff. This does assume a non solid axle (ie, proper independent suspension), but could easily be wrong with that assumption and that BMW thing.

And I agree totally that a bike hitting it in the side would stand virtually no chance of damaging the diff, let alone from behind (I probably should have worded my previous post a bit better to cover that).

Agree,   even if it was a independant remote diff,  no way would a bike have caused damage to the diff gearing...  :D

anyone maybe just thought that the fella didn't want to argue at the side of the road with a biker? some people are intimidated by bikers.  then just trying to give a bs excuse to stop being bothered by the person that went into the back of him?  afterall that is what we pay our insurance premiums for, you know, for someone else to sort out the mess

would it still be 50/50 if he was stopping/swerving to avoid a child running out into the road?

From the original description I suspect it will be treated as 100% the fault of leek74. He might have got something like 50/50 if he was overtaking and the guy turned into him but at present it just reads that he was sitting too close / failed to react and rode into the back of someone.

I was about to overtake.  :D
He did 1 flash of his indicator and slamed on his brakes. I could not go round as he was obviously going to turn across me, I braked as hard as I could to miss him but he turned changed his mind when he saw what was happening and straightened up back onto the correct side of the road. I hit him from behind because he left me know where to go by swerving across the road then back again with no warning.

Yes i'm to blame but not 100%.

I think the fact I could see all the way up the road due to my postioning, I would have seen the child as well :D

looks like just a scratch to me, and he had a bit of time to think about putting blame onto you. has happened to me before but they didnt win. if you got those pics he cant really claim much as insurance would look into it.

if were talking about insurance 'blame' then i am pretty certain both ins. co's will say u are 100% liable, you hit him because he stopped and you didn't.

as for the diff u need to speak to your ins.co. or a solicitor. the police wont be interested because he has not commited an offence and it will be down to you or your ins.co. to prove you did not do the damage as apposed to him proving you did.

If you have his address I wonder what his car looks like now? Before and after pics maybe?  :D

Does he know you have a pic of it at the time of the damage? I wonder if he would continue with his claim if he knew you did?

I do think maybe he has forgoten I took photo's, I didn't do it on the sly though I told him before I did it.

I've sent all the info and photo's of to the insurance today, so I guess I'll just have to see.
