got stopped on my track bike

i went out for a spin on my 09 r6 track bike on 5th july 2009 on the kimbolton road, a superbike went past me going the opposite way, when i looked over my shoulder at him he was turning round and i naturally thought he is going to try and race me. this was in kimbolton, i stuck to the speed limit through kimbolton and when out of kimbolton i opened it up, when i got up the road a bit the unknown rider was gone. i slowed down to see if he was behind me still and he appeared again, so i slowed down through the next village and on exit of the village i waved him past, as he came past all his lights and indicators started flashing blue, great  :o undercover copper on an 09 blade all black bike black leathers and black helmet.

pulled over, and he started to scrutineer my bike and being a right twat with his attitude, probably got bullied by kids on bikes when younger, he told me that the speed wasnt an issue  :005_sbiggrin:

1.5 hours i was at the side of the road while we waited for his mates to come and have a look, sad twat. when his fellow police bikers turned up they loved the bike and suggested to the undercover twat that he just let me go. He didnt look like he wanted to do that.

finally they let me on my way on the bike that apparently now 5 months later is a danger to the public  :LOL

i got a summons through on 10th dec 2009.

charges as follows

1. exceeding 60
2. exceeding 40
3. no brake light, no rear light, no reflector, no front light, no indicators, no mirrors, exhaust not for road use, no speedometer, no seat

my thoughts are

this was 5 whole months and a couple of days ago is this outside the time permitted for the summons to come through.

at the time i got stopped he said speed was not an issue i didnt know wether that was because a moving vehicle with a camera can not do a speed check or the twat was to far behind me to do it.

the bike was still within 3 years and didnt need an mot so i assumed that daytime mot rules would apply. (should have had a daytime mot done really :-[)

i have got a speedo fitted and a seat the twat.

how can i get out of this.

two wheeled wanka might be able to help on this one.  :wistle

They have 6 months to lay information for your case with the court in order to issue your summons.  So this is fine.

IIRC

Brake light isn't a legal requirement
Rear light isn't a legal requirement
Reflector is a legal requirement
Front light isn't a legal requirement
Indicators are not a legal requirement
Mirrors are not a legal requirement
Can they prove the exhaust is not for road use? Did they take pictures of the bike? Have you still got the standard exhaust you could put back on the bike?
Speedo and seat are pretty easily proved to be on the bike!

I'm sure if I'm wrong then someone will be along to correct me :D

Speak to someone at White Dalton, I hear they're the dogs with stuff like this  :thumbsup:

they didnt mention the number plate, i just wrote it on a piece of paper and stuck it on the undertray, probably legal actually  :LOL

There is no such thing as a "daytime MOT", you get an ordinary MOT with an advisory of not riding/driving between dusk til dawn  :thumbsup:
I would go see a solicitor for piece of mind if nothing else, I reckon you'd get away scot free as most on here would think, but how many of us are actually qualified to be 100% sure of this  :thumbsup:

You should be able to get a free consultation with a solicitor.

I always thought you needed brake light (but I am no expert in the law).

I have done a bit of checking and you are correct BC :thumbsup:

No lights is the best as if it does have lights then they need to work. But you do need to display a legal registration plate.

If you've got switches for the lights and indicators then the lights should be fitted and working

If you've removed the switches then you don't need lights or indicators

Basically whats fitted should work  :thumbsup:

You do need a legal sized numberplate

Not sure you even need a reflector with a daytime MOT but yours being new has a normal MOT with no notes for lack of lights,

You still need a working horn at all times
