Court date for speeding, advice please?
« on: August 05, 2010, 11:45:23 AM »
Hi all,

Got caught doing 101 on the A27 in April and have just received the summons for court on the 20th, will be pleading guilty as it was a fair cop.  What, in peoples experience, do you expect I'll get?  Looking around online I've found the maximum is 6 points, £1000 fine, 56 day ban, but think you get a ban OR points, not both.  Had an SP30 from 2004 but that has now been removed, otherwise my license is clean.  I've since sold my bike so thinking of using that to an advantage if possible - remorse, seen the error of ways etc ;)

Also, is it worthwhile getting a solicitor?  Had a quick look around at costs  :yikes  Will having one really be a saving in the long run?

Cheers

Oh dear. Not a great road to be done on right now. Sussex are obsessed with bikers this year (they're staking out the bridges, even yesterday in the rain) since the huge numbers of deaths so as much grovelling as possible I would think. I don't know about points and fines but reckon getting rid of the bike (for now) is a good start. Does your job depend on having the bike? Pleading for leniency on that is also a good idea from what I read on here before.

In the end, its the old adage, do the crime, do the time.

Good luck.   :LOL

As Pebbs says grovelling is good.

I've heard the "I've sold my bike ploy" doesn't hold water with some courts as if you keep your licence you can just go buy another bike anyway.

If a solicitor can keep the fine down to e.g. £200 instead of £1K then you've saved £800 right there. If they can avoid a ban for you as well then remember it will save you otherwise higher insurance premiums for years to come

tbh I hope you get what you deserve as you seemed to have had a "played" with bikes, helped to reinforce the stereotype that we're all a-holes on the road & you will further reinforce the Judiciary's already poor view of us by making out that you're done with all the nasty business of biking.
IMHO I don't care if they leave you rot in jail. :angryfire:

A bit harsh that Laverda and I don`t suppose you have ever done anything wrong on the bike.
But it goes to show bikers can be arseholes off the road too

(just my opinion but what do I know) ;)

ignoring firstly what laverda said  :thebirdman in my experience its the ones that do 60mph on motorways speed in city centres and towns. also laverda i think he's aware of the crime hence his guilty plea, personnally i believe everyone speeds sometime or other its just the old adage " theres a time and place for everything "

well you've been caught so tbh i think your in for a ban even though they dont take in to account they are lying bastards who's equipment is not tested by an independant tester :nono:

so i were you i would def go with a solicitor   selling your bike is a waste of time they dont care, remember where you are your in britain a boring useless country ran by generally old stupid idiots.... you need to try or your solicitor point out you cant keep your eye on the speedo 100% of the time its not like driving a car you have to read the rd and try to get across you were distracted and never realised the speed you were doing but also theres no excuse for exccesive speed  ;) if you have a car try to play on the i need a licence for work or i will be dismissed can you get a letter from work that may help

lastly dress smart not friggin jeans and a shirt a friggin suit and tie and have shave and a haircut i dont care if your a tree hugging save the planet prick lol do it as it will deffo help

of course i dont condone any illegal activities  :wistle.............. next time go a bit quicker and dont get caught lol....... :down

Was it a camera ? If not I'd be tempted to get a solicitor on the job, you never know
Might get a rabbit in the hat loophole, or at least argue the speed below 99mph, and as Mark say's, get your haircut laddie, shouldn't matter but it does  :-\

A bit harsh that Laverda and I don`t suppose you have ever done anything wrong on the bike.
As I said that's my opinion, I've been biking for nearly 30 years (Not gone away & come back, but always had bikes for nearly 30 years)& have been done once for a minor offence in my teens, so I think I've done pretty well, & not once in any of my cars.
So I think I'm entitled to voice my objection when I read of someone who goes daft & then sells his bike leaving us to put up with more prejudice.

AGAIN just my opinion. :005_stongue:

Thanks (to most).

I'll accept whatever I get, I was just wondering what other people have experienced in similar circumstances.  Will be checking around for solicitors though I reckon.

The suit is ready and waiting, and what little hair I have left shall be most neatly trimmed.

It was an unmarked BMW bike (RT?).  I spotted him in front of me and he left the dual carriageway only to rejoin behind me and I didn't see him until it was too late.  101mph over 0.94mile.

TBH a ban wouldn't be the end of the world for me, I do drive to work but the commute would just take a little longer on public transport and as I've only got a car at the moment I'm missing out on riding anyway.  Though I obviously won't say that in court...

Oh, I sold my bike because I got laid off in June (started working again last week) and couldn't afford the tyres/service/insurance it was going to need.  I'm hoping to get another one later on in the year or early next so if you can put up with all the extra prejudice until then I would most grateful. ;)
